Plausibility

Definition : Plausibility

Since the end of the 1990s, pharmaceutical litigation has seen the emergence of a new criterion of patentability: « plausibility ». Positively, it is a question of investigating whether the technical effect claimed can be plausible, and therefore considered true, in relation to the content of the patent application. Negatively, it is a question of ruling out a speculative effect, which is more a matter of science than of technology.
