Real seizure

Definition : Real seizure

The actual seizure for infringement   authorizes the physical removal of the alleged infringing objects. The bailiff, with a court order, confiscates or seals the offending products (e.g. goods, packaging) to prevent them from being put into circulation or to prevent the destruction of evidence. This is a more restrictive measure than descriptive seizure, as it temporarily deprives the holder of the seized item. It aims to preserve the evidence of infringement and to avoid any risk of modification or concealment.
