Employee invention

Definition : Employee invention

A A special legal regime is intended for employees whoseinvention was realized while theinventor inventor was bound to an employer by an employment contract. The very existence of the said contract is assessed according to various criteria derived from labor law, the main one of which is the relationship of subordination to the employer.

As it is a special system, which therefore derogates from the general system, the system of employee inventions is strictly interpreted. As a result, in principle only employees, in the strict sense, are concerned.

A lawyer specializing in employee inventions may be involved to assist either the employer or the inventor.
