Definition : Opt-out

In the context of the Unified Patent Court (UPC), opt-out refers to the possibility for European patent holders to choose not to submit their patents to the jurisdiction of the UPC. In other words, patent holders can choose not to be governed by the rules of the UPC and to continue to use national courts for their patent disputes.

The opt-out offers European patent holders the possibility to choose between the Unified Patent Court and national courts, depending on their strategic, procedural and financial preferences. This allows them to maintain a certain flexibility and to make decisions that best suit their specific needs in terms of patent litigation.
