{"id":7935,"date":"2022-06-24T11:05:43","date_gmt":"2022-06-24T11:05:43","guid":{"rendered":"https:\/\/www.dhenne-avocat.sea-dev-and-sun.fr\/2022\/06\/24\/blog-dhenne-avocats-8\/"},"modified":"2022-06-24T11:05:43","modified_gmt":"2022-06-24T11:05:43","slug":"blog-dhenne-avocats-8","status":"publish","type":"post","link":"https:\/\/www.dhenne-avocats.fr\/en\/blog-dhenne-avocats-8\/","title":{"rendered":"Starting point for additional remuneration for employee inventors"},"content":{"rendered":"<p><em><strong>Par sa d\u00e9cision du 1er\u00a0avril 2022, la Cour d\u2019appel de Paris s\u2019est prononc\u00e9e sur la d\u00e9termination du point de d\u00e9part de la prescription pour exiger une r\u00e9mun\u00e9ration suppl\u00e9mentaire li\u00e9e \u00e0 des <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/mission-invention\/\">inventions de mission<\/a>.<\/strong><\/em><br class=\"autobr\" \/><strong><br \/>\n<\/strong><\/p>\n<p>L\u2019affaire soumise \u00e0 la Cour d\u2019appel de Paris soulevait la question de la prescription \u00e0 l\u2019\u00e9gard de <strong>11<a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/invention-of-salary\/\">\u00a0inventions de salari\u00e9<\/a> inexploit\u00e9es r\u00e9alis\u00e9es entre 1999 et 2015<\/strong> et \u00e0 l\u2019\u00e9gard d\u2019inventions exploit\u00e9es issues d\u2019un partenariat de recherches achev\u00e9 en 2014. <strong>La prescription a \u00e9t\u00e9 jug\u00e9e acquise pour les deux cat\u00e9gories d\u2019inventions. D\u2019un c\u00f4t\u00e9, s\u2019agissant des inventions inexploit\u00e9es, conform\u00e9ment \u00e0 l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000019017112\/\">article\u00a02224 du Code civil<\/a>, le point de d\u00e9part de la prescription quinquennale a \u00e9t\u00e9 fix\u00e9 \u00e0 la date de d\u00e9p\u00f4t de brevet le plus tardif, soit en 2007, parce qu\u2019\u00e0 cette date la salari\u00e9e ne pouvait ignorer l\u2019existence de son droit \u00e0 une r\u00e9mun\u00e9ration suppl\u00e9mentaire. De l\u2019autre c\u00f4t\u00e9, s\u2019agissant des inventions exploit\u00e9es, qui \u00e9taient rattach\u00e9es au partenariat de recherches, conform\u00e9ment \u00e0 l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027566295\">article L3245-1 du Code du travail<\/a>, le point de d\u00e9part de la prescription triennale a \u00e9t\u00e9 fix\u00e9 \u00e0 la date \u00e0 laquelle la cr\u00e9ance \u00e9tait d\u00e9terminable, soit en d\u00e9cembre 2014, date de fin du partenariat.<\/strong><\/p>\n<p>Rappelons que la question du point de d\u00e9part du d\u00e9lai de prescription pour la r\u00e9mun\u00e9ration suppl\u00e9mentaire des <strong><a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/inventor\/\">inventeurs<\/a> salari\u00e9s<\/strong> a \u00e9t\u00e9 r\u00e9form\u00e9e par la loi du 17 juin 2008, modifiant l\u2019article 2224 du Code civil, auquel faisait r\u00e9f\u00e9rence l\u2019ancien article L3245-1 du Code du travail. Avant 2008, le d\u00e9lai de prescription ne pouvait commencer \u00e0 courir \u00e0 d\u00e9faut de d\u00e9termination et de certitude de la cr\u00e9ance. Depuis lors, ledit d\u00e9lai court \u00e0 compter de la date \u00e0 laquelle le salari\u00e9 \u00ab <i>a connu ou aurait d\u00fb conna\u00eetre<\/i>\u00a0\u00bb les faits lui permettant d\u2019exercer son action. Quant \u00e0 la dur\u00e9e du d\u00e9lai, auparavant d\u00e9cennale ou trentenaire, cette m\u00eame loi de 2008 la fixe \u00e0 cinq ans. D\u00e9lai par la suite r\u00e9duit \u00e0 trois ans pour les inventions de salari\u00e9s avec la loi du 14\u00a0juin 2013, modifiant ainsi l\u2019article L3245-1 du Code du travail.<\/p>\n<p>L\u2019arr\u00eat comment\u00e9 comporte deux enseignements.<\/p>\n<p>En premier lieu, la Cour applique le point de d\u00e9part \u00ab flottant \u00bb pr\u00e9vu par l\u2019article 2224 du Code civil, et repris \u00e0 l\u2019article L. 3245-1 du Code du travail, \u00e0 la prescription d\u2019une r\u00e9mun\u00e9ration de salari\u00e9. Cela implique, conform\u00e9ment \u00e0 ces textes, que la prescription commence \u00e0 courir \u00e0 partir du moment o\u00f9 le salari\u00e9 \u00ab a connu ou aurait d\u00fb conna\u00eetre \u00bb les faits lui permettant d\u2019exercer son droit. Or, les dispositions transitoires des lois de 2008 et 2013 pr\u00e9voient que \u00ab\u00a0<i>les nouvelles dispositions s\u2019appliquent aux prescriptions en cours \u00e0 compter de la date de leur promulgation sans que la dur\u00e9e totale de la prescription puisse exc\u00e9der la dur\u00e9e pr\u00e9vue par la loi ancienne<\/i> \u00bb. Ainsi, <strong>s\u2019agissant des <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/invention\/\">inventions<\/a> inexploit\u00e9es dont le point de d\u00e9part a \u00e9t\u00e9 fix\u00e9 \u00e0 novembre 2007, c\u2019est la prescription quinquennale de la loi du 17\u00a0juin 2008 qui s\u2019applique<\/strong>. Et, s\u2019agissant du partenariat dont le point de d\u00e9part a \u00e9t\u00e9 fix\u00e9 \u00e0 d\u00e9cembre 2014, c\u2019est la prescription triennale r\u00e9sultant de la loi du 14\u00a0juin 2013 qui s\u2019applique.<\/p>\n<p>En second lieu, <strong>l\u2019appr\u00e9ciation des Juges diff\u00e8re selon que les inventions soient inexploit\u00e9es ou exploit\u00e9es<\/strong>. Pour les inventions inexploit\u00e9es, il convient de retenir la date de la connaissance du droit \u00e0 r\u00e9mun\u00e9ration suppl\u00e9mentaire (date du d\u00e9p\u00f4t du brevet). Ainsi, la Cour infirme sur ce point la d\u00e9cision de premi\u00e8re instance, qui avait retenu que la prescription courait \u00e0 partir de la connaissance d\u2019un programme de r\u00e9mun\u00e9ration de salari\u00e9 dans l\u2019entreprise. <strong>Pour les inventions exploit\u00e9es, il convient de retenir la date de d\u00e9terminabilit\u00e9 du montant de la r\u00e9mun\u00e9ration suppl\u00e9mentaire<\/strong>. Cette appr\u00e9ciation in concreto conduit en l\u2019occurrence la Cour \u00e0 retenir la date de fin du partenariat de recherche.<\/p>\n<p>En fin de compte, <strong>nous retiendrons essentiellement de l\u2019arr\u00eat comment\u00e9 que le point de d\u00e9part \u00ab\u00a0flottant\u00a0\u00bb de la prescription aura conduit la Cour d\u2019appel \u00e0 consid\u00e9rer que la prescription commen\u00e7ait \u00e0 courir \u00e0 compter du d\u00e9p\u00f4t des demandes de brevets et non \u00e0 compter du moment o\u00f9 le programme de r\u00e9mun\u00e9ration suppl\u00e9mentaire a \u00e9t\u00e9 port\u00e9 \u00e0 la connaissance du salari\u00e9. Cependant, cette position semble li\u00e9e aux faits de l\u2019esp\u00e8ce (statut de la salari\u00e9e dans l\u2019entreprise), de telle sorte qu\u2019elle ne nous semble pas remettre en cause l\u2019utilit\u00e9 d\u2019une diffusion du programme de r\u00e9mun\u00e9ration suppl\u00e9mentaire aupr\u00e8s des salari\u00e9s<\/strong>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Par sa d\u00e9cision du 1er\u00a0avril 2022, la Cour d\u2019appel de Paris s\u2019est prononc\u00e9e sur la d\u00e9termination du point de d\u00e9part de la prescription pour exiger une r\u00e9mun\u00e9ration suppl\u00e9mentaire li\u00e9e \u00e0 des inventions de mission.
