Ainsi, le contentieux relatifs aux inventions de salari\u00e9s s\u2019est particuli\u00e8rement d\u00e9velopp\u00e9 depuis le d\u00e9but des ann\u00e9es 1990, en particulier \u00e0 propos des sommes susceptibles d\u2019\u00eatre attribu\u00e9es aux salari\u00e9s.<\/strong><\/em><\/p>\n<div>\n<p>L\u2019article L. 611-7 du Code de la propri\u00e9t\u00e9 intellectuelle est consacr\u00e9 aux inventions de salari\u00e9s. Par \u00ab\u00a0salari\u00e9s\u00a0\u00bb, il faut entendre toute personne li\u00e9e par un contrat de travail avec un employeur. Ainsi, les stagiaires ne sont, par exemple, pas vis\u00e9s. Dans ces cas, c\u2019est-\u00e0-dire en l\u2019absence de lien de de subordination, l\u2019article L611-6 est net\u00a0: l\u2019invention revient \u00e0 l\u2019inventeur (au stagiaire par exemple).<\/p>\n<p>En revanche, quand un lien de subordination existe effectivement, des contentieux tendent \u00e0 germer quand un salari\u00e9 quitte son employeur. Depuis le d\u00e9but des ann\u00e9es 1990 la jurisprudence se concentre essentiellement sur les sommes attribuables au salari\u00e9 selon qu\u2019il s\u2019agisse d\u2019une invention de salari\u00e9 dite \u00ab\u00a0de mission\u00a0\u00bb (<strong>I<\/strong>) ou d\u2019une invention de salari\u00e9 dite \u00ab\u00a0hors mission\u00a0\u00bb donnant droit, si elle est attribuable, \u00e0 un juste prix (<strong>II<\/strong>).<\/p>\n<h2 class=\"spip\">I. Invention de mission<\/h2>\n<p><strong>L\u2019invention de mission est celle r\u00e9alis\u00e9e par le salari\u00e9 en vertu d\u2019une mission inventive d\u00e9coulant soit du contrat de travail, qui comprend alors une mission inventive g\u00e9n\u00e9rale correspondant aux fonctions effectives du salari\u00e9, soit d\u2019une mission inventive sp\u00e9ciale r\u00e9sultant d\u2019\u00e9tudes et de recherches explicitement confi\u00e9es au salari\u00e9.<\/strong><\/p>\n<p>En contrepartie de l\u2019invention, le salari\u00e9 a droit \u00e0 une r\u00e9mun\u00e9ration suppl\u00e9mentaire, en principe analys\u00e9e comme une prime et non pas comme le prix de l\u2019invention. <strong>S\u2019agissant de l\u2019\u00e9valuation de ladite prime, la Cour de cassation a jug\u00e9 qu\u2019il \u00ab\u00a0<i>ne r\u00e9sulte d\u2019aucun texte l\u00e9gal ou conventionnel que la r\u00e9mun\u00e9ration due au salari\u00e9, auteur de l\u2019invention de mission, doive \u00eatre fonction de son salaire<\/i>\u00a0\u00bb (jurisprudence dite \u00ab\u00a0Raynaud\u00a0\u00bb)<\/strong><span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-1\" class=\"spip_note\" title=\"Cass. com., 21 nov. 2000, pourvoi n\u00b0 98-11900.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-1\" rel=\"appendix\">1<\/a>]<\/span>.<\/p>\n<p>N\u2019\u00e9tant pas fonction du salaire, ainsi que d\u00e9pendante de circonstances diverses pas pr\u00e9cis\u00e9es par la loi, l\u2019\u00e9valuation de la r\u00e9mun\u00e9ration se r\u00e9v\u00e8le d\u00e9licate, appr\u00e9ci\u00e9e au cas par cas, car li\u00e9es aux circonstances. Souvent une convention collective ou un accord d\u2019entreprise pr\u00e9voit de telles modalit\u00e9s de calcul. Il a r\u00e9cemment \u00e9t\u00e9 jug\u00e9 par la Cour d\u2019appel de Paris que dans ce cas un syst\u00e8me forfaitaire diff\u00e9rent de celui pr\u00e9vu par une convention collective, consistant en l\u2019occurrence dans le versement de diff\u00e9rentes primes pour diff\u00e9rentes inventions, devaient, au pr\u00e9alable, \u00eatre port\u00e9 \u00e0 la connaissance du salari\u00e9, ce qui n\u2019avait pas \u00e9t\u00e9 prouv\u00e9 en l\u2019esp\u00e8ce en l\u2019absence de toute mention dans le contrat de travail<span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-2\" class=\"spip_note\" title=\"CA Paris, 30 mai 2017, RG n\u00b0 16\/06557.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-2\" rel=\"appendix\">2<\/a>]<\/span>. En revanche, le bar\u00e8me interne compris dans un avenant au contrat de travail met le salari\u00e9 en connaissance de cause et lui est donc opposable. Ainsi, le salari\u00e9 ayant particip\u00e9 \u00e0 diff\u00e9rentes inventions pour lesquelles il re\u00e7ut d\u2019abord un premier versement puis ensuite un second versement 10 ans plus tard li\u00e9 \u00e0 l\u2019exploitation de l\u2019invention ne pouvait exiger un compl\u00e9ment conform\u00e9ment \u00e0 la convention collective des industries chimiques<span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-3\" class=\"spip_note\" title=\"CA Paris, 12 d\u00e9cembre 2017, RG N\u00b0 16\/10812.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-3\" rel=\"appendix\">3<\/a>]<\/span>.<\/p>\n<p>S\u2019agissant de l\u2019action en paiement que le salari\u00e9 peut intenter elle est soumise \u00e0 une prescription triennale, qui, selon la Cour de Paris, commence \u00e0 courir \u00e0 compter du jour o\u00f9 le salari\u00e9 avait connaissance des \u00e9l\u00e9ments n\u00e9cessaires au calcul de sa r\u00e9mun\u00e9ration suppl\u00e9mentaire<span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-4\" class=\"spip_note\" title=\"CA Paris, 2 mars 2018, RG n\u00b0 16\/23992.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-4\" rel=\"appendix\">4<\/a>]<\/span>. Dans un jugement du 23 mars 2018, le Tribunal de grande instance de Paris a d\u00e9cid\u00e9 que l\u2019action en paiement d\u2019un salari\u00e9 pour une invention de mission r\u00e9alis\u00e9e en 1998, dont il connaissait ou aurait d\u00fb conna\u00eetre les faits lui permettant d\u2019agir d\u00e8s 2006, \u00e9tait prescrite<span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-5\" class=\"spip_note\" title=\"TGI Paris, 23 mars 2018, RG n\u00b0 15\/00961.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-5\" rel=\"appendix\">5<\/a>]<\/span>.<\/p>\n<h2 class=\"spip\">II. Invention hors mission attribuable<\/h2>\n<p><strong>L\u2019invention hors mission est celle r\u00e9alis\u00e9e par un salari\u00e9 soit dans le cours de l\u2019ex\u00e9cution de ses fonctions soit dans le domaine des activit\u00e9s de l\u2019entreprise soit par la connaissance ou l\u2019utilisation des techniques ou de moyens sp\u00e9cifiques \u00e0 l\u2019entreprise, ou de donn\u00e9es procur\u00e9es par elle.<\/strong> Dans ces cas, l\u2019employeur a le droit, dans des conditions et d\u00e9lais fix\u00e9s par d\u00e9cret en Conseil d\u2019\u00c9tat, de se faire attribuer la propri\u00e9t\u00e9 ou la jouissance de tout ou partie des droits attach\u00e9s au brevet prot\u00e9geant l\u2019invention de son salari\u00e9.<\/p>\n<p>L\u2019employeur ne pourra cependant exercer son droit d\u2019attribution d\u2019une invention qu\u2019\u00e0 la condition de payer \u00e0 son salari\u00e9 un juste prix. En principe, ce juste prix, qui constitue le prix d\u2019une cession, devrait \u00eatre sup\u00e9rieur \u00e0 une r\u00e9mun\u00e9ration suppl\u00e9mentaire. De fait, depuis la jurisprudence Raynaud, ce n\u2019est pas n\u00e9cessairement le cas puisque la r\u00e9mun\u00e9ration suppl\u00e9mentaire conna\u00eet des modalit\u00e9s de calcul similaires.<\/p>\n<p>S\u2019agissant calcul du juste prix, la Cour de cassation a pos\u00e9 le principe selon lequel <strong>\u00ab\u00a0<i>si le juste prix doit \u00eatre \u00e9valu\u00e9 au jour o\u00f9 l\u2019employeur exerce son droit d\u2019attribution, des \u00e9l\u00e9ments post\u00e9rieurs \u00e0 cette date peuvent \u00eatre pris en compte pour confirmer l\u2019appr\u00e9ciation des perspectives de d\u00e9veloppement de l\u2019invention<\/i>\u00a0\u00bb<\/strong>. La Cour r\u00e9gulatrice rejetant en l\u2019esp\u00e8ce le pourvoi form\u00e9 contre un arr\u00eat qui avait augment\u00e9 le juste prix octroy\u00e9 au salari\u00e9 de 70.000 \u00e0 320.000 euros en tenant compte de l\u2019exploitation et des cons\u00e9quences de l\u2019exploitation post\u00e9rieure \u00e0 l\u2019attribution<span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-6\" class=\"spip_note\" title=\"Cass. com. 9 juillet 2013, pourvoi n\u00b0 12-22157.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-6\" rel=\"appendix\">6<\/a>]<\/span>. Dans un jugement du 12 octobre 2018, le Tribunal de grande instance de Paris a rappel\u00e9 que ce montant devait \u00eatre d\u00e9termin\u00e9 au regard des \u00e9l\u00e9ments fournis par les parties tant en fonction des apports de chacun que de l\u2019utilit\u00e9 industrielle et commerciale de l\u2019invention. Le Tribunal a ainsi fix\u00e9 l\u2019apport du salari\u00e9 \u00e0 20\u00a0%, d\u2019une part, puis jug\u00e9 que, faute de r\u00e9ponse explicite de l\u2019employeur dans les quatre mois de la d\u00e9claration d\u2019invention, la cr\u00e9ance \u00e9tait n\u00e9e \u00e0 la date du d\u00e9p\u00f4t de la demande de brevet<span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-7\" class=\"spip_note\" title=\"TGI Paris, 12 oct. 2018, n\u00b0 17\/02071.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-7\" rel=\"appendix\">7<\/a>]<\/span>. Le Tribunal de grande instance de Paris a \u00e9galement jug\u00e9 dans une d\u00e9cision du 20 avril 2017 qu\u2019une invention r\u00e9alis\u00e9e par un salari\u00e9 dans le cadre de l\u2019ex\u00e9cution de ses fonctions, sur son temps de travail et selon les instructions de son sup\u00e9rieur constituait une invention hors mission attribuable, bien qu\u2019aucune mission inventive ou de recherche ne fut mentionn\u00e9e dans son contrat de travail, puisque une telle qualification \u00e9tait en ad\u00e9quation avec ses fonctions successives technicien logistique puis d\u2019agent administratif. Ainsi, le Tribunal a accord\u00e9 au salari\u00e9 un juste prix \u00e9valu\u00e9 \u00e0 100.000 euros, parce que la contribution du salari\u00e9 \u00e0 la solution technique \u00e9tait \u00e9quivalente \u00e0 celle de l\u2019autre co-inventeur et sup\u00e9rieure \u00e0 celle de son employeur, lequel l\u2019avait uniquement mis industriellement en \u0153uvre<span class=\"spip_note_ref\">\u00a0[<a id=\"nh2-8\" class=\"spip_note\" title=\"TGI Paris, 20 avril 2017, RG n\u00b0 15\/15749.\" href=\"https:\/\/www.village-justice.com\/articles\/les-inventions-salaries,35293.html#nb2-8\" rel=\"appendix\">8<\/a>]<\/span>.<\/p>\n<p>S\u2019agissant de la prescription de l\u2019action en paiement du juste prix que le salari\u00e9 peut intenter, le Tribunal de grande instance de Paris a jug\u00e9 dans une d\u00e9cision du 9 f\u00e9vrier 2017 que, conform\u00e9ment \u00e0 l\u2019article 2224 du Code civil, la prescription commen\u00e7ait \u00e0 courir du jour o\u00f9 le salari\u00e9 a connu des faits donnant naissance \u00e0 son int\u00e9r\u00eat \u00e0 agir, en l\u2019occurrence du jour de la connaissance de l\u2019exercice de son droit d\u2019attribution par l\u2019employeur. Si en l\u2019esp\u00e8ce le salari\u00e9 n\u2019avait pas eu directement connaissance des d\u00e9p\u00f4ts de brevets, il en avait n\u00e9anmoins eu indirectement connaissance avec son bulletin de paie indiquant explicitement la premi\u00e8re prime brevet.
