Unlike that <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/mediation\/\"><strong>Mediation<\/strong><\/a>, the arbitrator has the power to settle the dispute, and their decision is binding.<\/p>\n<h2>Features<\/h2>\n<ul>\n<li><strong>Consensual<\/strong> The parties must have agreed to arbitration, usually via a <strong>arbitration clause<\/strong> inserted into a contract (e.g. licence agreement).<\/li>\n<li><strong>Adaptable<\/strong> The parties may choose the arbitrators, define the applicable rules, and determine the seat of arbitration.<\/li>\n<li><strong>Confidential<\/strong> Hearings and judgments are not public, protecting business and technical secrets.<\/li>\n<li><strong>International<\/strong> Arbitration is particularly well-suited for cross-border disputes, as arbitral awards are easily enforceable thanks to the <a href=\"https:\/\/uncitral.un.org\/sites\/uncitral.un.org\/files\/media-documents\/uncitral\/fr\/new-york-convention-f.pdf\"><strong>New York Convention (1958)<\/strong><\/a>.<\/li>\n<\/ul>\n<h2>Application to Patent Law<\/h2>\n<ol>\n<li><strong>Disputes over infringement and validity<\/strong>\n<ul>\n<li>Although some jurisdictions (particularly European ones) consider patent validity to be a matter for public authorities, related disputes, such as the scope of claims or infringement, may be submitted to arbitration.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Patent licences<\/strong>\n<ul>\n<li>Disputes concerning the performance, interpretation, or termination of <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/patent-patent-contract\/\"><strong>patent licensing agreements<\/strong><\/a> (including the <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/licence-frand\/\"><strong>FRAND licences<\/strong><\/a>) are often arbitrated.<\/li>\n<\/ul>\n<\/li>\n<li><strong>R&amp;D agreements and patent co-ownership<\/strong>\n<ul>\n<li>Disputes over the allocation of rights, the management of patents arising from research collaborations, or exploitation rights are often settled by arbitration.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Essential patent for a standard (BEN or in English Standard Essential Patent, \u00abSEP\u00bb)<\/strong>\n<ul>\n<li>When a dispute arises about a <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/patent-essential-a-standard\/\"><strong>essential patent for a standard<\/strong> <strong>BEN<\/strong><\/a> On the amount of FRAND royalties or access to an essential patent, arbitration can determine a <strong>royalty rate<\/strong> reasonable and resolve the conflict without judicial intervention.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h2>Advantages<\/h2>\n<ul>\n<li><strong>Technical expertise<\/strong> Arbitrators can be chosen from patent specialists or those from the relevant sector.<\/li>\n<li><strong>Speed<\/strong> The timescales are often shorter than a traditional trial.<\/li>\n<li><strong>Enforceable internationally<\/strong> Arbitral awards are enforceable in over 160 countries thanks to the <strong>New York Convention<\/strong>.<\/li>\n<li><strong>Confidentiality<\/strong> Essential for disputes involving sensitive technical information or financial data.<\/li>\n<\/ul>\n<h2>Limitations<\/h2>\n<ul>\n<li>Sometimes high cost of arbitrators' fees.<\/li>\n<li>Requires the prior agreement of the parties to resort to arbitration.<\/li>\n<li>It is not always possible to challenge an arbitral award (except in rare cases of serious irregularities).<\/li>\n<\/ul>\n<h2>Examples of bodies offering arbitration<\/h2>\n<ul>\n<li><strong>WIPO<\/strong> The WIPO Arbitration and Mediation Center offers specialist services for IP disputes, including those involving patents.<\/li>\n<li><strong>ICC (International Chamber of Commerce)<\/strong> Manages complex commercial arbitrations, including on IP.<\/li>\n<\/ul>","protected":false},"excerpt":{"rendered":"<p>L\u2019arbitrage est une m\u00e9thode de r\u00e9solution des litiges dans laquelle les parties soumettent leur diff\u00e9rend \u00e0 un ou plusieurs arbitres, qui rendent une d\u00e9cision contraignante, appel\u00e9e sentence arbitrale.
