(From 10xGenomics case to UPC \u201cseizure\u201d)"},"content":{"rendered":"<p>Readers are familiar with the story of the founding of the <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/unified-patent-jurisdiction\/\">UPC<\/a>, which \u201cobliged\u201d its founders to make it an <em>ad hoc <\/em>Court, not integrated into the European judicial system (with a reinforced cooperation agreement between the members of the UPC). The fragility of this system has provoked much criticism (e.g., our comments <a href=\"https:\/\/patentblog.kluweriplaw.com\/2022\/03\/23\/is-upc-victim-of-a-latent-vice\/\" data-wpel-link=\"internal\">here<\/a>). The intervention of the Court of Justice, which is always possible at the margins (when the UPCA must be read in the light of the European Treaties), may come sooner than expected, as one author had already predicted on this Blog (see <a href=\"https:\/\/patentblog.kluweriplaw.com\/2022\/06\/20\/upc-the-great-paradox-why-the-cjeu-could-bring-in-uniform-protection-and-equal-effect-when-interpreting-the-eus-external-patent-law-e-g-trips-notwithstanding-the-futile-ef\/\" data-wpel-link=\"internal\">here<\/a>). In any case, the European principles are already tending to give rise to difficulties in their interpretation, and most especially the proportionality principle (Directive 2004\/48, recital 22, art. 7 and 9).<\/p>\n<p>The first cases, concerning the preliminary injunction (\u201cPI\u201d) and the UPC \u201csaisie-contrefa\u00e7on\u201d, show that the principle of proportionality is omnipresent in the UPCA interpretation and, above all, surprising and contradictory (or misunderstood) depending on the measures requested.<\/p>\n<p>The 10XGenomics case provides us an interesting first case study in the way that the Court asserts the \u201cbalance of probability\u201d of Article 62(4) UPCA read in conjunction with 211.2 RoP. And this is more interesting (or worrying) because, as we have already seen, it is also the question of proportionality that seems to pose a problem for the UPC \u201csaisie-contrefa\u00e7on\u201d (<a href=\"https:\/\/patentblog.kluweriplaw.com\/2024\/03\/18\/upc-saisie-contrefacon-part-ii-the-oerlikon-case\/\" data-wpel-link=\"internal\">here<\/a> and <a href=\"https:\/\/patentblog.kluweriplaw.com\/2024\/03\/22\/upc-saisie-contrefacon-part-iii-the-c-kore-case\/\" data-wpel-link=\"internal\">here<\/a> and <a href=\"https:\/\/patentblog.kluweriplaw.com\/2024\/04\/03\/upc-saisie-contrefacon-part-iv-the-appeal-against-the-saisie-order\/\" data-wpel-link=\"internal\">here<\/a>).
