They know it far less as an operational risk. The day a bailiff appears at reception with an order and an expert, reception, security, IT, engineers and lawyers improvise, at the worst possible moment. Preparing for a saisie-contrefa\u00e7on means organising the company\u2019s response without obstructing a judicial measure. This programme builds the protocol and trains the teams in ninety minutes.<\/p>\n<h2>The need<\/h2>\n<p>The <a href=\"\/en\/intellectual-property-glossary\/infringement-seizure\/\">saisie-contrefa\u00e7on<\/a> is authorised on ex parte application, without adversarial debate, and carried out by surprise. The order sets out precisely what the bailiff may do: describe, sample, copy, seize. An unprepared company makes three kinds of mistakes. It obstructs the operations, which is a fault. It allows access to information outside the scope of the order, which exposes its secrets. It destroys or moves items, which turns against it. The protocol ensures that everyone knows whom to call, what to do and what never to do.<\/p>\n<h2>What you receive<\/h2>\n<ul>\n<li>A map of the sites and people to alert, with an escalation tree.<\/li>\n<li>A four-part protocol: reception, security, legal, IT.<\/li>\n<li>Quick-reference sheets by function: reception and security, IT, engineers, legal department.<\/li>\n<li>The rules on cooperation, observations recorded in the report, confidentiality and protection of trade secrets, including the request for documents to be placed under seal.<\/li>\n<li>An emergency line and tested crisis contact details.<\/li>\n<li>A simulation exercise and a corrections report.<\/li>\n<\/ul>\n<h2>Awareness training<\/h2>\n<p>First, a ninety-minute situation-based session, with practical cases by function and a final quiz. Next, a one-page sheet, \u201cthe first ten minutes\u201d, given to each participant. Finally, depending on the level of maturity, a two-hour tabletop exercise or a full on-site simulation, followed by a debriefing. Twenty per cent of the examples are adapted to the client\u2019s sector. A certificate and an improvement plan are delivered at the end. The client thus keeps dated proof of the training and of its updates.<\/p>\n<h2>How we work<\/h2>\n<p>The programme usually starts with the awareness training, which reveals the gaps. The protocol is then built with the functions concerned, from a questionnaire per site. An annual simulation and an emergency line can complete the set-up. The firm regularly carries out saisies-contrefa\u00e7on for its clients and assists companies subject to them: the protocol rests on this practice on both sides of the order.<\/p>\n<h2>Who it is for<\/h2>\n<p>Industrial sites and research centres exposed to competitors holding patents, companies exhibiting at trade fairs, distributors and importers, French subsidiaries of foreign groups whose crisis procedures do not cover this measure specific to French law.<\/p>\n<h2>Frequently asked questions<\/h2>\n<h3>Can a saisie-contrefa\u00e7on be refused?<\/h3>\n<p>No. The order is enforced. However, the company may require strict compliance with its scope, have its observations recorded, request protection of its secrets and later challenge the order or the operations before the judge.<\/p>\n<h3>Does the protocol also apply to the Unified Patent Court?<\/h3>\n<p>Yes. The UPC has a comparable measure, the order to preserve evidence and to inspect premises. The protocol takes its specific features into account.<\/p>\n<h3>How long does implementation take?<\/h3>\n<p>The training is rolled out within a few weeks.
