Une contrefa\u00e7on de brevet se produit lorsque quelqu&rsquo;un fabrique, vend ou utilise une <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/invention\/\"><strong>invention<\/strong><\/a> brevet\u00e9e sans l&rsquo;autorisation du titulaire du brevet. L\u2019<strong>Article L. 613-3 of the French Intellectual Property Code<\/strong> liste pr\u00e9cis\u00e9ment ces atteintes\u00a0: \u00ab\u00a0<em>a) Manufacturing, offering, putting on the market, using, importing, exporting, transhipping, or holding for the aforementioned purposes the product which is the subject of the patent;<\/em> <em>b) The use of a process covered by the patent or, when the third party knows or when circumstances make it obvious that the use of the process is prohibited without the consent of the owner of the patent, the offer of its use on French territory;<\/em> <em>c) Offering, marketing, using, importing, exporting, transhipping or holding for the aforementioned purposes the product obtained directly by the process covered by the patent.<\/em>\u00a0\u00bb L\u2019<strong>article L. 613-4 (1)<\/strong>\u00a0y ajoute la fourniture de moyens ayant permis la contrefa\u00e7on\u00a0:\u00a0\u00ab\u00a0<em>Est \u00e9galement interdite, \u00e0 d\u00e9faut de consentement du propri\u00e9taire du brevet, la livraison ou l&rsquo;offre de livraison, sur le territoire fran\u00e7ais, \u00e0 une personne autre que celles habilit\u00e9es \u00e0 exploiter l&rsquo;invention brevet\u00e9e, des moyens de mise en \u0153uvre, sur ce territoire, de cette invention se rapportant \u00e0 un \u00e9l\u00e9ment essentiel de celle-ci, lorsque le tiers sait ou lorsque les circonstances rendent \u00e9vident que ces moyens sont aptes et destin\u00e9s \u00e0 cette mise en \u0153uvre.\u00a0<\/em>\u00bb La contrefa\u00e7on de brevet peut entra\u00eener<strong> plusieurs probl\u00e8mes juridiques<\/strong>, notamment : <\/p>\n<ol>\n<li class=\"translation-block\"><strong>Civil liability<\/strong>. The patent holder can take legal action against the infringer to obtain damages for the violation of its intellectual property rights.<\/li>\n<li class=\"translation-block\"><strong>Criminal liability<\/strong>. In some cases, patent infringement can be considered a criminal offence, punishable by fines and imprisonment.<\/li>\n<li class=\"translation-block\"><a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/temporary-injunction-action\/\" target=\"_self\"><strong>Provisional injunction<\/strong><\/a>. The patent owner can also seek a court order prohibiting the infringer from continuing to manufacture, sell or use the patented invention.<\/li>\n<li><strong>Confiscation des produits contrefaits<\/strong>.
