{"id":7982,"date":"2022-10-13T11:54:16","date_gmt":"2022-10-13T11:54:16","guid":{"rendered":"https:\/\/www.dhenne-avocat.sea-dev-and-sun.fr\/lexique-propriete-intellectuelle\/https-www-dhenne-avocats-fr-lexique-propriete-intellectuelle-brevet-unitaire\/"},"modified":"2025-01-23T19:12:43","modified_gmt":"2025-01-23T19:12:43","slug":"unitary-patent","status":"publish","type":"lexique","link":"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/unitary-patent\/","title":{"rendered":"Unitary Patent"},"content":{"rendered":"<p class=\"translation-block\">The <strong>unitary patent<\/strong> is a <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/european-patent\/\" target=\"_self\"><strong>European patent<\/strong><\/a> issued by the <strong><a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/oeb\/\" target=\"_self\">EPO<\/a><\/strong> (European Patent Office) which, at the request of its holder, has a unitary effect for the territory of the 25 Member States participating in enhanced cooperation: an action for <strong><a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/infringement\/\" target=\"_self\">infringement<\/a><\/strong> or a <strong><a href=\"https:\/\/www.dhenne-avocats.fr\/en\/lexique-propriete-industrielle\/cancellation-action\/\" target=\"_self\">revocation action<\/a><\/strong> or even an <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/temporary-injunction-action\/\" target=\"_self\"><strong>action for a provisional injunction<\/strong><\/a> may then be brought for all these States simultaneously.<\/p>\n<p class=\"translation-block\">In concrete terms, once the European patent has been granted, the holder can opt for \u201cunitary\u201d protection by filing a specific request: from then on, the patent automatically covers all the countries that have ratified the Agreement on a Unified Patent Court and unitary effect. Thus, instead of multiple and sometimes costly national validations (translations, administrative formalities, etc.), the applicant benefits from <strong>centralized protection<\/strong> and potentially <strong>unified litigation<\/strong> before the <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/unified-patent-jurisdiction\/\" target=\"_self\"><strong>Unified Patent Court (UPC)<\/strong><\/a>.<\/p>\n<p class=\"translation-block\">The main aim of the unitary patent is to <strong>simplify<\/strong> and <strong>reduce<\/strong> post-grant procedures, cutting the costs of repeated validations and limiting the risk of jurisdictional differences. In practical terms, this title does not require traditional national validation formalities (or only light formalities), and offers uniform coverage in the participating Member States, together with more flexible dispute management (a single action before the UPC instead of <a href=\"https:\/\/www.dhenne-avocats.fr\/en\/intellectual-property-glossary\/contentieux-multi-juridictionnel-des-brevets\/\" target=\"_self\"><strong>multi-jurisdictional litigation<\/strong><\/a>). The implementation of this unitary patent is part of the \u201c<a href=\"http:\/\/www2.droit.parisdescartes.fr\/warusfel\/articles\/Brevet_unitaire_GallouxWarusfel13.pdf\" target=\"_self\"><strong>Patent Package<\/strong><\/a>\u201d, a set of European texts (including <a href=\"https:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2012:361:0001:0008:fr:PDF\" target=\"_self\"><strong>Regulation (EU) No. 1257\/2012<\/strong><\/a>) organizing both unitary protection and the competent jurisdiction (UPC). However, each Member State retains the freedom to ratify the agreement or not, so that not all of them are currently covered. Ultimately, the unitary patent constitutes a <strong>significant change<\/strong> in the patent system in Europe, in a quest for <strong>simplification<\/strong>, <strong>harmonization<\/strong> and <strong>cost reduction<\/strong> for innovators.<\/p>","protected":false},"parent":0,"template":"","class_list":["post-7982","lexique","type-lexique","status-publish","hentry"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.9 -
